Privacy Policy
Your contact information given to Perceptive Analytics is never sold, rented, leased, traded, swapped, exchanged, bartered, etc. We don't like junk mail, and know you don't either.
Scope
This Privacy Policy describes how we handle your personal information for our services on Perceptive Analytics. The policy that applies on any of our domains or sub domains is always the policy that appears in the footer of each website.
By accepting the Privacy Policy and the User Agreement in registration, you expressly consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. This Privacy Policy is effective upon acceptance for new users and is otherwise effective on April 1, 2018.
Collection
You can browse our sites without telling us who you are or revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us. If you choose to provide us with personal information, you consent to the transfer and storage of that information on our servers located in the United States.

Marketing
We don't sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising.
Use
Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience. You agree that we may use your personal information to:

- resolve disputes, collect fees, and troubleshoot problems;
- prevent potentially prohibited or illegal activities, and enforce our User Agreement;

We may disclose personal information to respond to legal requirements, enforce our policies, or protect anyone's rights, property, or safety.

- Members of our corporate family to help detect and prevent potentially illegal acts and provide joint content and services (for example, registration, transactions and customer support). Our corporate affiliates will send marketing communications only to users who request these services.
- Service providers under contract who help with our business operations (such as fraud investigations, bill collection, affiliate and rewards programs and co-branded credit cards).
- Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
- Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity. If your personal information will be used contrary to this policy, you will receive prior notice.)
Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from bad actors, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

We automatically scan and may manually filter messages to check for spam, viruses, phishing attacks and other malicious activity or illegal or prohibited content, but we do not permanently store messages sent through these tools. If you send an email to an email address that is not registered in our community, we do not permanently store that email or use that email address for any marketing purpose. We do not rent or sell these email addresses.
Security
Your information is stored on our servers located in the United States and may be in India. We treat data as an asset that must be protected and use lots of tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.
Third Parties
Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are bidders, buyers or sellers on our sites or other sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Perceptive Analytics does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We encourage you to ask questions before you disclose your personal information to others.
General
We may amend this Privacy Policy at any time by posting the amended terms on this site. All amended terms automatically take effect 30 days after they are initially posted on the Site. In addition, we will notify you through the Perceptive Analytics Message Center. If your questions are not answered online, you may write to us using the Contact Us form.
Terms of Service
By accessing or using the Services available from the domain and sub-domains of www.Perceptive-Analytics.com (the "Site"), you agree and acknowledge that you have read this Terms of Service and that you are henceforth bound by its terms and conditions, including those available by hyperlink (collectively, the "Terms of Service"). We reserve the right to revise the Terms of Service and all linked information from time to time in our sole discretion by updating this posting or any linked information. Unless otherwise provided in such revision, the revised terms will take effect when they are posted.
Definitions used in this Terms of Service
"Perceptive-Analytics" means Perceptive Analytics Private Ltd., a Company registered in Hyderabad, India, and owner of www.Perceptive-Analytics.com, (including www.peopletoworkwith.com) and sub-domains within www.Perceptive-Analytics.com as well as all the applications and frameworks within them.
"Services" These are analytics, business intelligence, data and other related Services Perceptive Analytics delivers.
"User" means
(1) A person who is a Registered User, using the Site on his or her own behalf, or
(2) A person who is using the Site on behalf of a Member that is a Company or an Organization
"Visitor" or a "Guest" means a person who is only visiting the Site (i.e., not a Registered Member or User)
"You" means the Visitor or Registered User accessing the Site or using the Services on the Site on his or her own behalf; or, if the Services on the Site are used on behalf of a company or organization, "you" means the Registered User for which the Services are used and the User who accesses the Site on behalf of such Registered User (and such User represents that he or she has the authority to do so on the Registered User’s behalf).
Who can register and changes in Terms of Service
Perceptive Analytics Services are available to only those legal entities and individuals in business who can form legally binding contracts. To become a Registered user, you must be at least 13 years old and must accept all of the terms and conditions in, and linked to, the Terms of Service. Perceptive Analytics reserves the right to change any of the Terms of Service. Perceptive Analytics also reserves the right in its sole discretion to refuse, suspend, or terminate service to anyone.
Access, Fair Use, and Interference
You agree that you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without Perceptive Analytics’s express written permission. Additionally, you agree that you will not: (a) take any action that imposes or may impose (in Perceptive Analytics’s sole discretion) an unreasonable or disproportionately large load on Perceptive Analytics infrastructure; (b) copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (other than content you have submitted to the Site) from the Site without the prior express written permission of Perceptive Analytics and the appropriate third party, as applicable; (c) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (d) bypass any measures Perceptive Analytics may use to prevent or restrict access to the Site or any subparts of the Site.
Warranty Disclaimer
The services provided hereunder are "as is" without warranty of any kind, either express, implied, statutory or otherwise, including, but not limited to, the implied warranties of title, non-infringement, merchantability or fitness for a particular purpose either express or implied, arising by statute or otherwise in law or from a course of dealing or usage or trade. Perceptive Analytics makes no representations or warranties of any kind, either express or implied, as to the quality, identity or reliability of any third party, or as to the accuracy of the postings made on the Site by and any third party. Some states and jurisdictions do not allow limitations on how long an implied warranty lasts, so some of the above limitations may not apply to you. Perceptive Analytics will not be liable for any loss that you may incur as a result of someone else using your password or account with respect to the services, either with or without your knowledge.
Limitation of Liability
In no event shall Perceptive Analytics be liable to you or any other Registered User for any special, indirect, consequential or punitive damages pursuant to this agreement, including but not limited to, loss of profits, loss of business opportunities or loss of goodwill, even if advised of the possibility of such damages.
Notwithstanding any other provision of this agreement, in no event will Perceptive Analytics liability to you for any action or claim related to the services provided under this agreement, not limited to third party representations, whether based on contract, tort, negligence or any other theory of liability or any other reason, exceed a sum of USD 250. Some states or jurisdictions do not allow for the exclusion or limitation of incidental or consequential damages, so this limitation and exclusion may not apply to you.
Release from claims, demands, and damages
If the advent of a dispute, You hereby waive the California Civil Code 1542 (and any analogous law in any other applicable jurisdiction). In case of a dispute with another Registered Member, you release Perceptive Analytics (and Perceptive Analytics officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute.
Indemnity
You agree to defend, hold harmless and indemnify Perceptive Analytics from and against any and all losses, costs, expenses, damages or other liabilities incurred by Perceptive Analytics from and against any cost, liability, loss, damage, cause of action, claim, suit, proceeding, demand or action brought by a third party against Perceptive Analytics resulting from: (i) your decision to supply credit information via the Site, including personal financial information; (ii) any negligent or intentional wrongdoing by any Registered Member; (iii) your decision to submit requirements and accept proposals from other Registered Members; (iv) your decision to submit proposals and accept projects for execution; (v) any breach of contract or other claims made by Registered Members with which you conducted business through the Site; (vi) your breach of any provision of this Agreement; (vii) any liability arising from the tax treatment of payments or any portion thereof; (viii) any act or omission of yours with respect to the payment of fees to any Professional; (ix) any act or omission of yours with respect to the delivery of services to any Buyer; (x) your dispute of or failure to pay for services to Professionals; (xi) your obligations to a Professional or a Buyer; (xii) your use of the Site. You agree to defend, hold harmless and indemnify Perceptive Analytics from and against any and all losses, costs, expenses, damages or other liabilities in connection with your use of the Services including any payment obligations incurred through use of the Services.
Intellectual Property (Inherent Marks in the website)
Except as expressly stated above, nothing in the Terms of Service confers any license under any of Perceptive Analytics's or any third party's intellectual property rights, whether by estoppel, implication or otherwise. The Perceptive Analytics logo and name are trademarks of Perceptive Analytics, and may be registered in certain jurisdictions. All other product names, company names, marks, logos and symbols on the Site may be the trademarks of their respective owners. Perceptive Analytics and its licensors retain all of its right, title and interest in and to all patent rights, inventions, copyrights, know-how and trade secrets relating to the Site..
Intellectual Property (License and Site Access to Perceptive Analytics)
Subject to and conditioned on compliance with the Terms of Service, Perceptive Analytics grants you a limited license to access and, if you are a Registered User, to use this Site internally for the purpose of awarding and receiving the Services, and using Perceptive Analytics systems and tools for managing your engagements available and authorized from this Site. You must not use any content or application on this Site on any other Web site or in a networked computer environment for any purpose except your own internal viewing. You must not sell, reproduce, distribute, modify, display, publicly perform, prepare derivative works based on, repost or otherwise use any content of this Site in any way for any public or commercial purpose without prior written consent of Perceptive Analytics or the rights holder. You will not attempt to reverse engineer or attempt to interfere with the operation of any part of this Site unless expressly permitted by law. This Site or any portion of this Site may not be reproduced, duplicated, copied, sold, resold or otherwise exploited for any commercial purpose that is not expressly permitted by Perceptive Analytics.
No Agency Relationship
The Terms of Service and any registration for or subsequent use of this Site will not be construed as creating or implying any relationship of agency, franchise, partnership or joint venture between you and Perceptive Analytics, except and solely to the extent expressly stated under the Terms and Conditions of this Agreement.
Responsibility for Taxes and Legality
Each Registered User is solely responsible for complying with all income tax, payroll tax, payroll withholding, sales and use tax, governmental reporting and all other local and international legal requirements under applicable laws, including without limitation those applicable to the purchase and sale of Services from and by Professionals, and independent contractors. Perceptive Analytics is only a facilitator and Registered Users are responsible for the content they upload in the Site.
In addition, Users are solely responsible for ensuring that they comply with the copyright laws applicable.
Dispute Resolution Mechanism
If a dispute arises between you and Perceptive Analytics, our goal is to resolve such dispute quickly and cost effectively. Accordingly, you and Perceptive Analytics agree that Perceptive Analytics will resolve any claim or controversy at law or equity that arises between us out of this Agreement or the Perceptive Analytics Services (a "Claim") mutually by contacting each other. You agree to contact us directly to seek a resolution by contacting us.
If a dispute arises between a Buyer and a Professional, both the parties agree hereby to follow the Dispute Resolution Mechanism set forth by Perceptive Analytics
Notices and Communications
All notices to Perceptive Analytics intended to have a legal effect concerning this Agreement must be in writing and delivered either in person or by a means evidenced by a delivery receipt, to the following address:

Perceptive Analytics will communicate with you by email or by posting communications on this Site. You consent to receive communications from us electronically and you agree that these electronic communications satisfy any legal requirement that such communications be in writing. You will be considered to have received a communication when Perceptive Analytics sends it to the email address you have provided to Perceptive Analytics on this Site, or when Perceptive Analytics posts such communication on this Site. Jurisdiction
The Terms of Service are governed in all respects by the laws of the State of Telangana without giving effect to any principle that may provide for the application of the law of another jurisdiction. You agree that any claim or dispute you may have against Perceptive Analytics must be resolved by a court located in Hyderabad, Andhra Pradesh and You hereby submit to this jurisdiction. Any cause of action you may have with respect to this Site must be commenced within 30 days after it arises, or the cause of action is barred.
Arbitration
For any claim arising between you and Perceptive Analytics (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute in a cost-effective manner through binding non-appearance-based arbitration. A party electing arbitration must initiate such arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: (a) the arbitration will be conducted by telephone, online and/or be solely based on written submissions, the specific manner will be chosen by the party initiating the arbitration; (b) the arbitration will not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and (c) if an arbitrator renders an award the party receiving the award may enter any judgment on the award in any court of competent jurisdiction.
Disclaimer towards Third Party Links

You acknowledge and agree that Perceptive Analytics is not responsible or liable for: (i) the availability or accuracy of such Sites or resources; or (ii) the content, advertising, or products on or available from such Sites or resources. Termination
This Terms of Service Agreement shall become effective upon your acceptance or your use of the Site, and shall continue until terminated by Perceptive Analytics or you as provided for under the terms of this Section.
Unless otherwise agreed to in writing between the parties, either party may terminate the Agreement at any time upon notice to the other party. In such event, (i) Perceptive Analytics shall continue to perform those Perceptive Analytics Services necessary to complete any open transaction between you and another Registered Member; and (ii) you shall continue to be obligated to pay Perceptive Analytics and any Professionals for any Services for which you have engaged from Perceptive Analytics or such Professionals in order to complete any such transactions.
Without limiting Perceptive Analytics's other remedies, Perceptive Analytics may issue a warning, temporarily suspend, indefinitely suspend or terminate your registration and refuse to provide any Services to you if: (a) you breach any terms and conditions of the Terms of Service or the linked policies and information incorporated herein by reference, including our written policies and procedures posted on the Site; (b) Perceptive Analytics is unable to verify or authenticate any information you provide to us; or (c) Perceptive Analytics believes that your actions may cause legal liability for you, our Registered Users or for Perceptive Analytics. Once temporarily suspended, indefinitely suspended or terminated, you may not continue to use the Site under the same Account, a different Account or reregister under a new Account.
Without limiting Perceptive Analytics's other remedies, to the extent you engage in actions or activities which circumvent the Perceptive Analytics Site or otherwise reduce fees owed Perceptive Analytics under the Terms of Service, you will pay Perceptive Analytics for all fees owed to Perceptive Analytics and reimburse Perceptive Analytics for all losses and costs (including any and all Perceptive Analytics employee time) and reasonable expenses (including attorney fees) related to investigating such breach and collecting such fees.
When your Registered User status is terminated, you may no longer have access to data, messages, files and other material you keep on the Site. The material may be deleted along with all your previous posts and proposals. The provisions entitled "Warranty Disclaimer", "Limitation of Liability", "Release", "Indemnity", "Intellectual Property- License and Site Access", “Intellectual Property - Inherent Marks”, "Notices and Communications", " Dispute Resolution", "General", and "Service Charges and Subscriptions Policy" will survive termination of this Agreement.
General
You are responsible for compliance with applicable local laws, keeping in mind that access to the contents of this Site may not be legal for or by certain persons or in certain countries. Perceptive Analytics will not be considered to have modified or waived any of our rights or remedies under the Terms of Service unless the modification or waiver is in writing and signed by an authorized representative of Perceptive Analytics. Delay or omission by Perceptive Analytics in exercising its rights or remedies will not impair its rights or be construed as a waiver. Any single or partial exercise of a right or remedy will not preclude further exercise of any other right or remedy. If any part of the Terms of Service is held to be unenforceable, the unenforceable part will be given effect to the greatest extent possible and the remainder will remain in full force and effect. You will not transfer, assign or delegate your rights or obligations (including your Account) under the Terms of Service to anyone without the express written permission of Perceptive Analytics, and any attempt to do so will be null and void. Perceptive Analytics may assign this Agreement in its discretion.
Except for the payment of service charges to Perceptive Analytics, neither of the parties to this Agreement shall be responsible for the failure to perform or any delay in performance of any obligation hereunder due to labor disturbances, accidents, fires, floods, telecommunications or Internet failures, strikes, wars, riots, rebellions, blockades, acts of government, governmental requirements and regulations or restrictions imposed by law or any other similar conditions beyond the reasonable control of such party. The time for performance of such party shall be extended by the period of such delay.
The Terms of Service and all documents referenced in the Terms of Service comprise the entire agreement between you and Perceptive Analytics with respect to the use of this Site and supersede all prior agreements between the parties regarding the subject matter contained herein as well as any conflicting or inconsistent terms in any Web site that link to or are linked from this Site.
Payment for Perceptive Analytics Services
Buyer has to make its payment to Perceptive Analytics as per the terms of payment agreed with the Professional. Perceptive Analytics will promptly transfer the payment to Professional after deducting its service fees. Perceptive Analytics will not keep any money on behalf of Buyer or Professional. Thus, Professionals will receive an amount that is the project costs billed by them minus the Perceptive Analytics fees.
